When the situation in the city of Groningen shelter returns to normal, the trial of the process availability location (PBL) in Ter Apel will continue. This is indicated in a letter from State Secretary for Justice and Security Eric van der Burg to the House of Representatives. The PBL approach has also been adapted in many ways for the reopening.
The primary target of the PBL is foreigners who have little chance of staying in the Netherlands, i.e. asylum seekers whose applications are likely to fail. These are asylum seekers from safe countries and people who have already been granted asylum in other European countries.
At the beginning of March, the court ruled in favor of a foreigner who challenged the PBL’s restriction of his freedom. The trial was then suspended. The court evaluated what improvements could be made from a legal perspective as a result of the ruling. Subsequently, the court decided to adjust its working methods.
Register twice a day
The aim is to expand the scope of the trial at Ter Apel, where foreigners must register twice a day, Van der Burg writes. If the foreigner fails to register and/or causes a nuisance, section 56 of the Dutch Aliens Act may apply. The foreigner must then remain on site. This measure is also implemented if the foreigner causes a nuisance on the premises of Ter Apel or steals outside the premises. The foreigner is placed at the PBL, where he will participate in an intensive daily program for the asylum procedure and return.
VAN DER BERG: “I think it is important that asylum seekers whose application to remain in our country but who may have failed, can move through the asylum procedure quickly and, moreover, that we have adequate opportunities to deal with troublesome asylum seekers. The PBL trial has proven to have added value in this regard. I therefore hope that the situation in Ter Apel will soon make it possible to introduce further developed trial variants.”
Expand to Budel
The State Secretary still hopes to reopen the PBL in Ter Apel as soon as possible. To this end, he is in contact with the municipality of Cranendonck to see if another such PBL can be opened in Budel. Together with the Central Agency for the Reception of Asylum Seekers, the State Secretary will assess whether asylum seekers whose applications are likely to fail and who are not living in the PBL can be structurally accommodated elsewhere in the country. This should result in a more balanced distribution in terms of the intake of asylum seekers.
