The purpose of the European Court of Human Rights is to hold states accountable for human rights violations. States and individuals can file cases with the European Court of Human Rights. In 2020, the Netherlands brought a case against the Russian Federation at the European Court of Human Rights for its role in the shooting down of flight MH17 over eastern Ukraine on July 17, 2014. All 298 people on board, including 196 Dutch citizens, were killed.

MH17: Netherlands files application against Russia

The Netherlands considers that the Russian Federation played a significant role in the downing of flight MH17. The Netherlands also considers that the Russian Federation has not adequately investigated the matter and has not fully cooperated with requests for information from Dutch authorities. The Netherlands considers that this conduct of the Russian Federation and the Russian Federation’s continued denial of any involvement in the downing of flight MH17 have caused additional suffering to the next of kin of the victims. Moreover, Russia itself has not provided any legal remedies for the next of kin of the victims.

The Netherlands’ international application is being examined together with several international applications filed by Ukraine against the Russian Federation in relation to actions taken by the Russian Federation in eastern Ukraine since 2014. The final application joining this group of cases is an international application filed by Ukraine against the Russian Federation in relation to the war in Ukraine since February 2022.

The next step toward justice

The hearing on 12 June 2024 into the downing of flight MH17 is an important step towards finding the truth, holding those responsible accountable and achieving justice for all victims and their next of kin. The applicant and third parties who have intervened (including next of kin) will have the opportunity to present their views at the hearing. The court will not make a judgment immediately after the hearing. The ECtHR dealt with the case quickly but it may take another year to make a judgment.

The hearing will take place at the European Court of Human Rights in Strasbourg on Wednesday, June 12, 2024, at 9 a.m. and will be open to the public. A video recording will be available after the hearing.
