SPAK has completed its investigation into former Lushnja mayor Fatos Tushe and sent the file to trial.
The former Socialist mayor was charged with the criminal offence of “refusing to declare, failing to declare, concealing or falsely declaring the assets, private interests of an elected official, a public servant or any other person who has a legal obligation to declare them”.
SPAK stated in an official announcement that the defendant, Fatos Tuše, the former mayor of Lushnje, falsely declared assets and interests and concealed assets, interests and expenses.
“In the periodic/annual declaration of private interests in 2017, 2018, 2019, 2020, or in the declaration of private interests after leaving office in 2021, no expenditure was declared for the purchase/ordering of an apartment with a total amount of 82.33 square meters, located in Lungomare, Vlora, or for works and furniture, the actual total amount of which (investment value 2,262,000 lek). The investigation proved that the defendant Fatos Tushe, despite being the “de facto” owner of the apartment in Lungomare, Vlora, had been hiding the property. Currently, the property has been preventively seized. Similarly, in the periodic/annual declaration of private interests in 2018, 2019, 2020, or in the declaration of private interests after leaving office in 2021, he did not declare loans/debts received by IL citizens in accordance with the Personal Income Tax Law. The Special Prosecutor’s Office against Corruption and Organized Crime in Tirana has completed its preliminary investigation and submitted a request for trial in criminal case No. 199/1 of 2021 to the Specialized Court of First Instance for Corruption and Organized Crime, with the citizen defendants being:
- Fatos Tushcharged with a criminal offence”Refusing to declare, failing to declare, concealing or falsely declaring the assets or private interests of elected officials, public servants or any other person who has a legal obligation to declare. Forms of concealment and false declaration as provided for in paragraph 2 of Article 257/a of the Criminal Code.
Judging from all the actions and evidence during the investigation, it is beyond doubt that the defendant, Fatos Tushe, the former mayor of Lushje, falsely reported assets and interests and concealed assets. Interest and expenses in these statements:
- No expenditure on the purchase/order of an apartment with a total area of 82.33 m2 was declared in the regular/annual private interest declarations in 2017, 2018, 2019, 2020, or in the private interest declarations after leaving office in 20212located in Lungomare, Vlora, or for works and furniture, the actual total amount of which (investment value 2,262,000 lek). The investigation proved that the defendant Fatos Tushe, despite being the “de facto” owner of the apartment in Lungomare, Vlora, had been hiding the property. Currently, the property has been preventively seized pursuant to Decision No. 12. 136., February 29, 2024, Special Court of First Instance for Corruption and Organized Crime;
- Failure to declare loans/debts received by IL citizens in the periodic/annual declaration of private interests in 2018, 2019, 2020, or in the declaration of private interests after leaving office in 2021, according to the notarized statement No. 3124 Representative, No. 1320 Col., dated September 15, 2020, Notarized AM;
- In the declaration of private interests after leaving office, index No. 2021 09559 did not declare investments in the purchase of two cars, model “S350CDI 4MATIC” (value paid 39,620 euros) and “C200CDI”, brand “Mercedes-Benz” (value paid 7,290 euros), for a total of 46,910 euros.
