The Competition Commission conducted a surprise inspection at the headquarters of Sun Wave Pharma SRL, active in the food supplement distribution market, as part of an in-depth investigation into possible violations of unfair competition rules.
“The inspection is part of an in-depth investigation into possible violations of unfair competition rules by Sun Wave Pharma, which allegedly put pressure on the manufacturer Geltec Private Ltd. to stop supplying food supplements to Bleu Pharma SRL, its competitor on the national market”, according to a press release from the Competition Board. The analysis was triggered by a notification sent by Bleu Pharma SRL: “In this new case for unfair competition practices, we are looking at the conditions of commercial transactions between partners, which are contrary to honest practices and, at the same time, undermine the activities of smaller players on the market”, said the Chairman of the Competition Board, Bogdan Chiriţoiu. The surprise inspection was authorized by the Bucharest Court of Appeal, on the grounds of the need to obtain all the information and documents necessary to clarify possible unfair competition practices. The sources cited stressed that the inspection does not imply a pre-emptive declaration of guilt by the competition authority.
If the Competition Commission finds that an infringement of fair competition rules has occurred, the authority will order measures to prohibit the conduct and issue a ruling, based on which the court can decide on compensation to be awarded to Bleu Pharma SRL.
