Lucknow: The Uttar Pradesh cabinet on Tuesday passed an ordinance to prevent leakage of question papers and use of unauthorised means in examinations, with a penalty ranging from two years’ jail term to life and a fine of up to Rs 1 crore.
The move comes in the wake of several recent incidents of leaking of examination papers of state police recruitment and Public Service Commission Examining Officer and Assistant Examining Officer examinations.
Finance Minister Suresh Khanna told reporters that the ordinance was approved at a state cabinet meeting chaired by Chief Minister Yogi Adityanath. Under the ordinance, those caught leaking question papers will face a jail term ranging from two years to life, Khanna said at a press conference after the cabinet meeting. Such violators will also be fined up to Rs 1 crore, he added.
The minister said the ordinance covers examinations of State Public Service Commissions, Subordinate Services Selection Boards, Uttar Pradesh Board, universities and their nominated institutions. He added that the ordinance will also apply to any type of recruitment examination, regularisation or promotion examination, entrance examination for degree certificates or education certificates.
Khanna said that under the decree, distributing fake examination papers and creating fake job search websites are also punishable offences. He said that if the examinations are affected, the financial burden will be recovered from the “answer paper gangs” and institutions. Service providers who commit irregularities in the examinations will be permanently blacklisted and their properties may also be confiscated.
Under the ordinance, all offences are criminal offences, non-bailable and tryable in circuit courts. Strict provisions have also been made for bail, he added. The minister also said that since Parliament is not in session at the moment, a proposal has been made to replace the bill with an ordinance. Once the cabinet approves the proposal, the process of making the ordinance will be completed and it will be implemented.
He said the ordinance was brought out of urgent need and would be promulgated in accordance with the provisions of the Constitution.The move also comes at a time when alleged irregularities in NEET-UG and UGC-NET examinations are raging in the country.
