The Bolzano Regional Administrative Court (TAR) has suspended the authorization for the killing of two wolves in Val Venosta, signed on August 9 by Arno Kompatscher, president of the Autonomous Province of Bolzano. The ban will last until September 24, when the precautionary application filed by Leal, Leidaa, Oipa and the association “Zampe che Give a Hand” (represented by lawyer Aurora Loprete) will be examined. The Green Impact association will intervene immediately.

The associations’ appeal was based on various claims, including violations of the Habitats Directive and Articles 9 and 117 of the Italian Constitution. The associations argued that the regulation authorizing the killing of the two wolves failed to take into account the proportionality and gradualism required for such an intervention, and did not adequately assess the impact of the killing on the wolf population.

The Higher Institute for Environmental Protection (Ispra) also stressed that the criteria for “trapping” a wolf have not yet been clearly defined, making it difficult to assess the severity of the damage caused to farmers and whether there is a need to derogate from the protection of the species.

The recent ruling of the European Court of Justice against Austria highlights the importance of guaranteeing a satisfactory conservation status for the species at territorial and national level, as well as the importance of evaluating alternative solutions and balancing economic interests with conservation objectives before authorizing a cull.
