A joint bench of Justices Til Prasad Shrestha and Balkrishna Dhakal heard a petition filed by former chief minister Kedar Karki in the Supreme Court on Wednesday. The bench has ordered that it be sent to a full bench and the hearing will be held in a full bench from June 27.
Kedar Karki, who assumed office as chief minister, did not get a confidence vote within 30 days after political parties involved in the government withdrew their support, as provided for in Article 168 of the constitution.
Among them, UML parliamentary party leader Hikmat Kumar Karki was appointed as the chief minister on the 27th by Baisak after receiving the support of the majority of members of the state assembly. The outgoing chief minister Kedar Karki filed a writ in the Supreme Court against the chief minister’s decision.
During the arguments on Wednesday, legal practitioners from the opposition also asked the Constitution Bench as Article 5 should be interpreted. But a bench of Justice Shrestha Dhakal referred the case to a full bench for hearing.
The writ petition sought the cancellation of the governor’s call for forming a government on 26 Baisakh, the resolution passed by the provincial assembly on 7 Baisakh and the cancellation of the appointment of Hikmat Karki as governor. Chief Minister. Similarly, on 28 Baisakh, the Supreme Court asked the opposition to file a reply to a petition filed by Kedar Karki seeking his continuation as chief minister.
On May 9, the court ordered the transfer of documents of the chief minister’s appointment process. On June 16, he was not sent to see the writ despite paying the fee.
