Chapter 1 Legislative and Regulatory Measures
1. On the basis of a report by the Minister of Justice and Human Rights and Keeper of the Seal, the Council of Ministers adopted a draft decree establishing a statute for magistrates.
Law No. 02-054 of December 16, 2002, which establishes the status of magistrates, relates to the evolution of the law, socio-economic changes and our country’s membership in the main international and social groups and international commitments, and reveals: application, inadequacy.
The adoption of the Bill corrects the shortcomings noted and brings about the following innovations:
– Lord Inquisitor Competition Award;
– Consider the license-master-doctorate system when recruiting forensic auditors;
– Implement a new assessment procedure based on more objective criteria to replace the current rating practice;
– Introducing the principle of functional mobility in the career of magistrates;
– Strengthen the irrevocability of the magistrate’s seat;
– Consideration of provisions in support of magistrates who are called to serve in other ministries;
– Awarding badges and buttons to justices of the peace;
– Details on the termination of functions;
– In case of disciplinary or professional misconduct, it is possible for an authority other than the Minister responsible for justice to refer it directly to the High Council of Magistrates;
– Only the Supreme Judicial Council recognizes the prerogative to declare a ban on the practice of law in case of disciplinary offences;
– Strengthening the dissemination of decisions of the Supreme Council of Magistrates on disciplinary matters;
– Introduce the concept of Honorary Magistrate to recognise the merits and dedication of retired Magistrates who have provided exemplary service.
2. Based on the report of the Minister of Economy and Finance, the Council of Ministers adopted the draft order on the fight against money laundering, financing of terrorism and proliferation of weapons of mass destruction in the African member States of the West Monterrey Union.
The fight against money laundering and the financing of terrorism is governed by Uniform Act No. 2016-008 of March 17, 2016, which applies to all countries in the West African Economic and Monetary Union region.
The mutual evaluation of our system and that of other countries of the West African Economic and Monetary Union carried out by the West African Intergovernmental Action Group against Money Laundering from 2017 to 2022 highlighted deficiencies in technical compliance and effectiveness in the fight against money laundering, terrorist financing and proliferation of weapons of mass destruction.
In order to correct these shortcomings and adapt the legislation of the countries of the Union to the requirements in this area, the Council of Ministers of the West African Economic and Monetary Union adopted a draft unified law on combating money laundering and the financing of terrorism, as well as the proliferation of weapons of mass destruction in its member States.
The adopted draft decree transposes the provisions of the uniform law into domestic law.
The main innovations that attracted attention were, in particular:
– Insertion of regulations formalizing the role of the National Financial Information Processing Unit in risk assessment;
– Expand the scope of the law to combat the financing of the proliferation of weapons of mass destruction;
– Revise the list of persons subject to the jurisdiction of the Financial Action Group, based on the three categories established by the Group;
– Insertion of provisions criminalizing the financing of the proliferation of weapons of mass destruction and the failure to implement related targeted financial sanctions;
– Criminalize money laundering and terrorist financing in accordance with FATF Recommendations 3 and 5;
– Taking into account the obligations of financial institutions with regard to electronic funds transfers;
– Consider obligations for money transfer operators in accordance with FATF Recommendation 14.
3. Based on the report of the Minister of Urban Planning, Housing, Real Estate, Territorial Planning and Population, the Council of Ministers adopted:
Yes. A draft decree authorizing and declaring as public utility the construction works of the 200 MWp Nienguekoro photovoltaic solar power plant, the 10.56 km long connection line works to the Sanankoroba 225/33 KV substation and its access to the 20 km road to the n7 Sanankoroba national road, located in the rural commune of Sanankoroba, Kati Cercle, Koulikoro region;
b. A draft decree authorizing and declaring the construction of the 2×50 MWp Saffo photovoltaic solar power plant in the rural commune of Saffo, in the Kati circle of the Koulikoro region, by the public utility company.
The construction works of the Nienguekoro and Safo photovoltaic solar power plants and works related to their connection and road construction have encroached upon private property which must be expropriated for reasons of public utility in accordance with the provisions of the Land and Land Law.
The draft decree was adopted within this framework.
In the Communication section
1. The Minister of Transport and Infrastructure informed the Council of Ministers that the 2024/2025 navigation activities of the Mali River Navigation Company will soon begin.
The mission of Mali River Navigation Company is to provide public services by opening up inland waterways to the outside world.
People along the Niger River prefer river transport by boat as it ensures communication between the southern and northern regions of Mali.
By transporting goods, the company provides the right supplies to enclave areas that can only be reached by river, especially during winter and river flooding.
Given the satisfactory evolution of the Niger River water level, the 2024-2025 navigation campaign will begin on August 15, 2024, with the departure of the Modibo Keita ship from Mopti to Kabala, Timbuktu region. This campaign is planned to ensure 66 rotations.
2. The Minister of Labour, Civil Service and Social Dialogue informed the Council of Ministers that the recruitment process for the National Civil Service for the 2023 fiscal year has been concluded and the results are scheduled to be announced on Friday, August 16, 2024.
3. The Minister of National Entrepreneurship, Employment and Vocational Training informed the Council of Ministers that a youth training program in the field of photovoltaic equipment installation and maintenance will be established.
The solar industry holds great promise for the inclusion of young people, especially in rural and semi-urban areas. Therefore, there is a need to enhance the employability of young people and women by providing them with skills to install, maintain and repair photovoltaic equipment.
It is in this context that the state Minister of Entrepreneurship, Employment and Vocational Training is considering setting up a youth training program in the field of installation and maintenance of the above-mentioned equipment.
The training project aims to contribute to reducing unemployment among young people and women in Mali by developing and improving their skills through specialized training and professional integration opportunities in the growing energy sector.
Renewable energy, especially solar photovoltaic power generation.
The testing phase of the training program is scheduled to start on August 16, 2024.
4. The Minister for the Promotion of Women, Children and the Family informed the Council of Ministers of the progress made in the commemoration of Pan-African Women’s Day on 31 July 2024.
The national theme for the 2024 Pan African Women’s Day celebrations is: From Yesterday’s Teachers to Today’s Teachers: Women at the Forefront of Rebuilding Through Education.
The session was attended by the Ministers responsible for the promotion of women and gender equality of the Republic of Guinea, Burkina Faso and the Republic of Niger as part of the Alliance for the Sahel.
Commemorative events were held in several regions, including Kayes, Koulikoro, Sikasso, Sigu and San.
5. The Minister of Industry and Trade informed the Council of Ministers that an exchange meeting would be held with the private sector on the issues, challenges and prospects for the creation of an Alliance for the Sahel States.
On August 5, 2024, the Minister of Industry and Commerce held a meeting with various sectors of the private sector to discuss economic issues, challenges and the prospects for the creation of an alliance of Sahel countries.
The discussion focused on the Niamey Declaration issued on 6 July 2024 by the Heads of State of Mali, Burkina Faso and Niger, which covers the following:
– To achieve sustainable development through endogenous economic and social policies based on the unique resources of the three countries and a partnership that respects each other’s sovereignty;
– Pool resources to implement build and integration projects;
– Creation of an investment bank for the Alliance for the Sahel and establishment of a stabilization fund;
– Free movement of persons, goods and services within the Sahel Alliance.
As part of the implementation of this Declaration, the economic model defined by the Transitional President aims to support existing production units with a view to increasing and
Modernize its production capabilities.
In addition, the discussion focused on digital operations of the government to ensure better quality of services to the people.
The next consultation meeting of Sahel Alliance Ministers of Commerce and Industry and private sector representatives is scheduled for the end of September 2024.
