The Allahabad High Court has dismissed a plea by the Muslim side challenging the maintainability of a case filed by Hindus over the Shahi Idgah mosque-Krishna Janmabhoomi dispute in Mathura. The ruling was delivered by Justice Mayank Kumar Jain, whose verdict was reserved till June 6, 2024.
Consolidation of Litigation
Justice Jain’s court is dealing with 18 suits related to the dispute, of which 15 have been joined for joint hearing. The Muslim side has filed an application under Section 7 (11) of the Civil Procedure Code, challenging the maintainability of the suit which claims that 13.37 acres of land in Mathura, including the area of Shahi Idgah mosque, belongs to Krishna Janmbhoomi.
Background of the dispute
The lawsuits involve a 13.37-acre plot of land in Keshav Devkatra and the main claim is to remove the Shahi Idgah mosque from the land. Lord Krishna’s followers claim that the mosque was built on the land belonging to the god and the actual birthplace of Lord Krishna lies beneath it. They accuse the Muslims of constructing an illegal structure on Krishna Janmbhoomi land.
Court decision
The High Court heard arguments extensively from both sides in multiple hearings. The judgment was initially stayed on May 31, later re-settled to give Adv Pracha more opportunity to address the court, and then stayed again in June. Ultimately, the High Court dismissed the plea of the Muslim side and confirmed the maintainability of the Hindu case, thus paving the way for further legal proceedings on the merits of the case.
