User Rights – Riding a bicycle, motorcycle, scooter, etc.: What is the obligation to wear a helmet?
The variety of travel modes sometimes makes the regulations regarding the wearing of helmets somewhat unclear.
1- On two motorized wheels
Any driver or passenger of a motorcycle, motor tricycle, motor quadricycle or moped must wear an approved helmet (ECE) when on the road. Wearing this helmet is mandatory. Drivers who violate this rule will be fined €135 and have 3 points removed from their driving licence.
This offence may also render the vehicle immobile. Finally, please note that in order to comply with the requirements, the helmet must have four reflective elements (reflective strips).
2- Bicycles and non-motorized vehicles
It is not compulsory to wear a helmet when riding a bicycle (even an electric bicycle), except for children under 12 years old, who must wear an attached and approved helmet, whether driver or passenger.
In case of non-compliance, the fine is €135.
Helmets are not required when riding scooters without motors, roller skates or skateboards.
3- Traveling in a motor vehicle
You do not need to wear a helmet when riding a hoverboard (electric skateboard), electric unicycle, Segway, light bicycle (electric balance car, electric scooter with seat) or even an electric wheelchair or electric scooter for PMR (person with reduced mobility).
E-scooter users are only required to wear helmets when riding outside urban areas.
Finally, be aware that if you are involved in an accident, not wearing a helmet may result in your compensation for damages resulting from violating laws regarding helmet wearing being reduced or eliminated.
