Coriano, August 20, 2024 – The City Council approved, during last night’s meeting (Edited on August 19), a new regulation for the granting of public works, services and supplies through a below-the-threshold procedure. New Public Contracts LawOr Legislative Decree 36/2023, which replaces the previous one from 2009 and, in addition to listing the general principles applicable to sub-threshold procedures and all product categories of services, goods and works, also sets out the criteria for the application of the principle of rotation between all potentially eligible operators and the exceptions to this obligation.
Another important point is the requirement governing the direct allocation procedure, namely the €40,000 threshold.
For contracts with a value below this threshold, the company is required to provide a declaration in lieu of an affidavit of possession of the required participation and eligibility requirements. In this case, the Municipality verifies the declaration by a random draw, before January 30 of each year, within the 5% range of the direct allocations carried out from January to December of the previous year. For contracts over 40,000 euros, all checks and obligations are carried out in accordance with the requirements of Legislative Decree 36/2023.
In addition to adapting to new procurement guidelines, the regulation also aims to achieve Maximum transparency and timeliness in the awarding of public contracts with a more streamlined and simplified procedure, in accordance with the directives of ANAC (National Anti-Corruption Agency).
