Heitanda, June 23. The dispute between people’s representatives regarding the policies, plans and budget of Bagmati Rural Municipality in Makwanpur East district has been brought to the court.
Bagmati Rural Municipality Vice President Fanindra Timalsina and four district presidents have filed a petition in the Hetaunda bench of the Patan High Court seeking a stay on the implementation of the policy and programme proposed on June 10 and the budget for the next fiscal year 2081/82.
Along with Vice President Timalsina, Bagmati-9 district president Punram Ghalan, district 8 president Indramani Timalsina, district 6 president Tek Bahadur Dimdung, district 7 president Uttar Bahadur Bholan appointed Hetaunda-5 district Prabhakar Regmi as Wares and submitted a writ written in the court on Sunday.
In the petition, it was alleged that the policy, plan and budget were illegally introduced without constituting the Local Government Administration Act, 2074, the Local Revenue Consultative Committee, the Resource Monitoring and Budget Delimitation Committee under Section 66 and the Budget and Plan Formulation Committee under Section 67.
The writ states that when asked to create environment for village head Sirkesh Ghalan and chief administrative officer Jhamknarayan Ghalan to complete the committee, appoint member secretaries and hold meetings, they illegally replied that “we will do everything, the village council “sit and pass on, you don’t need to do anything”.
It was claimed in the writ petition that Section 67 of the Act provides for the Budget and Planning Committee and Section 66 provides for the Budget and Planning Committee to prepare the budget and plan and budget and budgetary procedures under the coordination of the Vice President.
Lawyer Madankumar Dahal said the hearing of the case in which village council president Sarkes Ghalan, chief administrative officer Jhamknarayan Ghalan and village headman filed the petition as opponents has been informed.
The rural municipality was supposed to submit its budget for the next fiscal year 2081/82 by June 10. However, the rural municipality announced its policies and plans for the next fiscal year only on this day.
The precinct chairperson and vice chairperson sat in a sit-in at the township office as the policy and plan were presented. Chief Administrative Officer Garland said the rural municipality presented the policy and plan on June 10.
The petition mentioned that the Vice President and the District Collector failed to perform their duties as prescribed by law, the Municipal Council Chairman and the Chief Executive failed to constitute the subject committee, the Chief Executive failed to provide the budget limit till the end of Chaitra, and the Rural Municipal Ward Council was unable to set the budget limit and submit the budget to the Municipal Council.
An interim order has been sought not to implement the budget passed by the village council on June 10 until the petition is finally decided.
