According to the survivor’s mother, her 17-year-old daughter, who suffers from BroadCast Unitedlectual disabilities, was alone at home with her father on the day of the incident in March 2019.

A special POCSO court on Wednesday sentenced a 57-year-old man to ten years in jail for raping his mentally challenged minor daughter five years ago.

Special Judge RK Kshirsagar found the man guilty of rape under the Indian Penal Code and the Protection of Children from Sexual Offenses Act (POCSO).

Detailed orders were not immediately available.

According to the mother of the survivor, her 17-year-old daughter, who has BroadCast Unitedlectual disabilities, was alone at home with her father on the day of the incident in March 2019.

The woman said in her complaint that she came home from get off work and noticed her daughter’s clothes looked disheveled.

The girl started crying when she saw her, but when her mother tried to question her, she said nothing and went out, the complaint said.

In April 2019, the mother saw her husband kissing and touching her daughter inappropriately. She then reported the case to the Trombe Police Station in the city.

During the trial, the court found the father guilty based on medical evidence and the testimony of the survivor’s mother.

Due to cognitive impairment, the 17-year-old girl remained silent when she was summoned to the court to record her testimony.

Her mother told the court that she was in a state of not being able to understand anything since she was born. The mother told the court that she consulted many doctors for her daughter but there was no improvement.

Prosecutors Rashmi Tendulkar and VD More examined six witnesses to prove the case.

The girl’s mother was the main witness and her evidence was corroborated by medical reports.
