On August 7, 2024, the criminal case of the Zangiota District Court was heard in open court against a citizen suspected of wearing clothing that made it impossible to identify him in his building. Gazeta.uz studied the verdict.
According to court documents, an administrative report was issued against a citizen, MA (female), for walking in a public place in an unrecognizable manner at around 11:51 am on August 2, 2024. The identity was formally determined on Mustaqillik Street in Amir Temur Community, Zangiota District.
During the court hearing, MA said that in September 2023, he was working as a worker in a furniture store in the Zangiota district. At 11:50 am on August 2, 2024, when the woman went to the grocery store on Mustaqillik Street in the district to buy bread and hard products with a “mask” (medical mask) on her face, IIB officers stopped her. She stopped and asked for his ID. The woman told them that she was allergic to dust, so she wore a mask, and her office was also dusty.
According to court documents, the woman told the IIB officer that she did not have any documentation about her condition and did not know she could not wear a mask in public. He apologized for not removing the mask because he was in a hurry to get off work.
The woman told the court that her family was in difficult circumstances, she had minor children, and she was a single woman, and asked the court to grant her relief.
After hearing the woman’s testimony, the court said, “After an in-depth study of the administrative work documents, and by reviewing the administrative work documents, reports, photo forms, explanatory letters and other objective evidence in this case, the criminal’s guilt was proved.” ” The conclusion was reached.
The court held that the woman had committed an administrative violation under Article 184-quater of the Administrative Liability Act (being in a public place in a manner that does not allow identification) and ordered her to face the administrative penalty provided for in Article 33 of the Administrative Liability Act (the lesser administrative penalty applies) and to impose a fine of 5 (five) times the basic calculation amount, i.e. 1,700,000 soums.
For reference, Article 184-4 of the Code on Administrative Liability, that is, covering the face in a public place to the extent that the identity cannot be recognized, a fine of 10 to 15 times the BHM (from 3 million 300 thousand (from 4 million soums to 4 million (950 thousand soums)) is imposed.
However, the following exceptions apply:
- Wearing a special helmet based on medical advice or to ensure traffic safety;
- Covering the face in situations related to labor and service activities;
- covering the faces of participants in sports and cultural events;
- Face coverings in other situations expressly permitted by law
