On the morning of May 31, 2024, government security personnel working in Ava village stopped a car coming from the western side of the island because it did not have passenger seat belts.

When officers approached the car, the driver displayed a Hawaii driver’s license and his name, Dale Foster.

Government representatives were informed that the driver had received a warning on 20 May for driving a vehicle in American Samoa and was required to obtain a local driver’s license as he expected to stay in the Territory for more than 30 days.

The defendant was told that the police would seize the car because he did not have a local driver’s license.

According to government documents, the defendant was ordered to exit the vehicle, turn toward the car and put his hands up. The defendant removed the bag from his shoulder and jumped out of the vehicle. Police continued to search the suspect for weapons and placed them inside the police vehicle.

Before the defendant’s car was locked, the security officer saw the defendant’s bag on the back seat and confirmed with the defendant that it was his bag and he wanted to take it. But when the officer reached for the bag, he found a gun inside. The defendant was then asked if it was a gun, and the defendant replied that it was.

Police opened the bag and found a loaded gun with bullets hidden inside the bag, according to government records. Police confiscated the unlicensed gun.

The accused was detained and taken to Tafuna Police Station.

Foster was charged with one count of Possession of a Prohibited Weapon, a Class “A” Misdemeanor, punishable by up to one (1) year in prison, or a fine of up to $1,000, or both.

A fixed amount of $300 can be used to release a defendant from jail during the trial.
