The portal “What Happens in Kaunas” discovered that the Kaunas prosecutor has launched an administrative case aimed at cancelling two transactions related to plots of land owned by Matijošaičius in the Vičiūnai microdistrict.

“The Public Interest Protection Department of the Kaunas District Prosecutor’s Office has filed an administrative lawsuit demanding the cancellation of the administrative acts and transactions and the return of the two plots of land to state ownership.

The Prosecutor’s Office defends the public interest of state-owned land that may have been illegally transferred to private ownership. Currently, the case is still pending. In order not to affect the judicial review of administrative cases, more detailed information will not be published,” said a comment sent by a representative of the Kaunas Prosecutor’s Office.

According to the Registration Center, the rights to the land reverted to natural persons on July 11, 2019, and less than a month later the plots were purchased by Š. Matjosatis and his wife.

The addresses of the above plots have not yet been announced, they are located in the recreational area of ​​Išlákos Street next to Nemunas.

The two seized plots of land on Kruonis Street have an area of ​​about 10 acres. They generally border on two D. Matijošaitis plots, which have an area of ​​more than 20 acres.

Although on the surface the expropriated land seemed small compared to other lands owned by the Matijošaičiai, their occupation ensured that no new neighbors would appear next to their house on the banks of the Nemunas River.

The seized plots of land are very close to the coastline.

The decision of the Regional Administrative Court stated that the application for seizure was necessary because the defendants might take measures that would complicate the application for restitution.

“The applicant (prosecutor – au.post.) also asked the court to adopt a means to ensure the claim – prohibiting the transfer of the disputed plots to third parties in any way and reorganizing them in any way (reform, merger, etc.). He said that the possibility that the disputed plots could be transferred to third parties was not excluded, which could complicate the trial and the execution of the court’s decision.

In addition, considering that the disputed plot has not yet been given an address and that the plot is adjacent to other plots of the defendant’s close relatives, there is a possibility that the plot will be returned to the state. It may be combined with other circumstances,” the court wrote in its ruling.

Browsing the map of the Nemunas Embankment Vičiūnai Microdistrict Registration Center, you can also see other newly formed plots belonging to Š. Matijošaitis and other natural persons.

As previously announced in the light rail investigation, on the basis of the Prosecutor’s Office’s commitment to defend the public interest, representatives of the Matijošaičiai family filed a request on behalf of the owners to the State Land Administration, which in turn applied to the Kaunas City Planning and Building Department regarding the formation of the plot. It is noteworthy that earlier, the department rejected the owner’s request, stating that there was no free land at the designated location, but when the woman representing Matijošaičius applied for the same plot, the land quickly became free, the plot was quickly formed and transferred to NŽT. Soon, the new plot was purchased by Matijošaičiai or a company managed by him.

Using such a scheme Sh. Matijošaitis bought at least 34 plots of land in the most attractive areas.

The seizure of land under court order comes into force from January 2023 but has not been publicly announced anywhere.

This is not the only case in Vichunai where the family of the mayor of Kaunas has to fight for the land and real estate under administration.

Both plots of land are adjacent to the land of his brother Dainius Matijošaitis, who is also a member of the city council. The mayor of Kaunas, Visvaldas Matijošaitis, also lives nearby.
