Travel agencies do not have to refund customers when they go bankrupt

When buying a holiday online, it is important to pay attention to whether it is the official website of the travel agency (CK) or the official website of the tour operator (CA). This difference is particularly noticeable in the event of bankruptcy, as the CA does not have to return the funds to the customer. David Gavaľa, owner of CK Daka, points this out.

“A common practice among fraudulent travel agencies is that they pretend to sell tours from one travel agency and sign a contract with another travel agency without having a valid contract with that travel agency. The client pays the travel agency thinking that he is buying a tour. The tour is offered by the travel agency, but the tour agency no longer sends it to the tour operator,” Gavaľa said.

He said that those interested in taking a holiday with CA should check on CK’s official website whether the agency is included among its contracted suppliers. “CA does not offer its own products, but provides the products of other CAs under contract. However, unlike CA, the agency does not have to take out bankruptcy insurance by law. This means that if it goes bankrupt, it will not have to return the money to its customers,” Gavaľa pointed out.

He added that if CK goes bankrupt, it is necessary to contact the insurance company from which it purchased bankruptcy insurance. This information should also be stated directly in the travel contract. The insurance company will determine the specific time when the customer registered and the total price of the damaged customer.

“If the travel agency is adequately insured, the client will receive a full refund for the trip. If the travel agency is underinsured, this premium will be reduced proportionally. If the travel agency does not have valid insurance, the client is not entitled to any payment, so it is imperative that you have an office that is insured according to the law,” Gavaľa explains.

Digitalization experts at AMCEF Milan Cák draw attention to fake online travel sellers.

“On their website, they sell tours from well-known travel agencies by simply copying photos from the original website, giving customers the feeling of buying a holiday from a well-known travel agency,” he said, adding that their goal could be to also obtain and misuse sensitive data such as passwords, credit card numbers or login information.
