Three days of debate devoted to Communist Party’s constitutional appeal

The hearing on the constitutional complaint filed by Inspector General of Police (CP) Anil Kumar Dip against Director of Public Prosecutions (DPP) Mr Rashid Ahmine will be held from September 11 to 13. The King’s Advisor (KC), Mes Paul Ozin for the Communist Party, Sir Charles Geoffrey Cox for the Democratic Progressive Party and Marc Rainsford for the Independent Commission Against Corruption, will face off in front of Parliament for three days. In its petition, the Communist Party sought a declaration from the Supreme Court that the DPP had usurped its authority in deciding the bail of Akhil Bisesur, Bruno Lauret, the Singhs and Chavan Dabidin. In his reply, Me Sanjay Bhuckory, a senior lawyer representing the DPP, said that the power of the Communist Party lies in Police Law and not in the Constitution. KC Paul Ozin responded to Me Bhuckory at the hearing on March 19, the provisional charge involved the investigation phase of arrest and detention, and argued that CP was the only captain on board. Mr Bhuckory described the situation as a dangerous precedent. “We live in a democracy, not a police state.” The full bench in its judgment rejected the objections raised by the DPP. Hence, the Supreme Court scheduled the hearing from September 11 to 13. Me Ahmine has also retained the services of senior advocates Narghis Bundhun, Mr. Sanjana Bhuckory, Mr. Amira Peeroo and Mr. Vimalen Reddi, as well as Senior Lawyer Vijay Dwarka.
