The plaintiff has evidence to believe that the defendant and his accomplices conspired to murder and harbor Mr. Chuwong. But Pol. Lt. Col. Banyin denied this, claiming that it was an accident. The incident took place in Bangchalong Subdistrict and Bangkao Subdistrict, Bang Phli District, Samutprakarn Province. and Nong Bon Subdistrict, Prawet District, Bangkok.

The first instance court ruled on January 20, 2021 that the defendant’s actions and this was a premeditated joint act with the intention to kill others. In order to retain the benefits of his misconduct to cover up his own mistakes or avoid being punished for the crimes he committed, he conspired with them to plan and commit murder. The judge found the defendant guilty based on Articles 289 (4) (7) and 83 of the Criminal Code and sentenced him to death.

The defendant then appealed on August 25, 2022. The Court of Appeal reviewed the advisory conference documents and held that: The defendant did commit the criminal acts charged. The appeal was not heard. The Court of Appeal agreed and affirmed the original judgment.

Mr Anek Khamchum, a lawyer for Mr Chuwong’s relatives, said the Supreme Court’s verdict on the case was read out at the Phra Khanong Criminal Court this morning. The original verdict was upheld and Ban Yin was sentenced to death. But we still have to wait for the verdict to know the specific details.

In this regard, the Supreme People’s Court’s judgment upheld the original verdict and sentenced the defendant to death. The Supreme Court agreed with the judgments of the Court of Appeal and the Court of First Instance that the defendant was guilty of the crimes stipulated in Sections 289(4)(7) and 83 of the Criminal Code. All appeals by the defendant were dismissed. Invalid.
