The Supreme Administrative Court rejected the Green Party’s appeal. AM “Struma” is about to be completed.
The Supreme Administrative Court has issued a final decision as of today (August 30, 2024) allowing the preliminary implementation of the decision of the Minister of Environment and Water Resources Petar Dimitrov, which has assessed the construction of the “Struma” highway along the G10/50 scheme from Towers through the Kresna Gorge to Sofia without the need for a new environmental impact assessment.
This decision of the Supreme Administrative Court is one of 14 cases filed by green NGOs against the completion of the “Struma” highway. The specific complainants against the administrative actions of the Ministry of Environment and Water are the “Association” “Bulgarian Parks Association” founded by Toma Belev and the “Balkan Wildlife Association” founded by Andrey Kovachev, the former co-chairman of the “Green Movement” party.
The court found that the complaints of the two environmental NGOs were without foundation. The SAC found that the completion of Struma AM was extremely important for the European transport network and was therefore one of the national priority projects, forming part of the TEN-T network, which must be completed by 2030. It made Bulgaria.
In addition, any delay in the construction of the Struma Expressway will harm traffic safety and the lives and health of citizens, and will also have a negative impact on national security and traffic accessibility.
The court noted that the section of the “Struma” highway that passes through the Kresnen Gorge is the most dangerous section of the country’s entire transportation network and that, despite the installation of limit posts, any delay would mean new accidents.
The Supreme Administrative Court held that the appellant had no concrete arguments to prove that the construction of the Struma motorway (type G10/50) along the Kurata-Sofia route would have an adverse impact on the environment. The decision is final and cannot be appealed. Judge Pavlina Naydenova signed the agreement while signing the dissenting opinion.
