Republican presidential candidate Donald Trump intends to use the military in domestic law and order missions, including patrolling the border, suppressing protests and fighting crime in major cities, if he wins the November election.

Trump’s allies have been working on documents to make the legal case for the politician, who has publicly talked about using the military over illegal immigration, but privately discussed the possibility of using the military to “stop unrest” at protests, according to the New York Times, citing an email “from a group close to Trump.”
During his first term as president, Trump criticized his advisers, calling them “losers,” for opposing his idea of using federal troops to quell mass protests sparked by the death of African American George Floyd, who died in police custody in May 2020. The politician has repeatedly floated the idea of using the military to secure the country at the border, and according to former aides, he has proposed shooting the most aggressive protesters and illegal immigrants in the legs.
The New York Times noted that U.S. governors can deploy the National Guard in the event of a riot or disaster, but the Local Police Act, passed in 1878, limits the military’s power to intervene in law enforcement matters. They cannot operate domestically without permission from Congress.
Exceptions are made to the Insurrection Act of 1807, which allows the president to use soldiers to suppress lawlessness and rebellion in certain circumstances. The law was last used in 1992, when Representative George H.W. Bush moved troops to Los Angeles. Rioting there began after a court acquitted four white police officers who beat black motorist Rodney King during his arrest. 63 people died.
During this campaign, Trump said that if he returned to the White House, he would send in the military if necessary, without asking local authorities to intervene. In particular, at a rally in Iowa in 2023, he promised to use federal forces to “keep crime out of our cities” – New York, Chicago, Los Angeles and San Francisco, calling them “dens of crime” that, he stressed, are controlled by Democrats.
“Where the rule of law has truly broken down, such as in the most dangerous areas of Chicago, the next president should use every power at his disposal to restore order — including, if necessary, sending in the National Guard or the 2022 August 2022 Trump said in a statement shortly before announcing his candidacy for president.
