They were charged with three counts of conspiracy to commit a misdemeanor in violation of Section 368 of the Penal Code, idleness and disorderly conduct in violation of Section 166 of the Penal Code, and public nuisance in violation of Section 160 of the Penal Code.
The prosecutor said that on June 23, 2024, at London Corner, Kanifing, Republic of The Gambia, the defendants conspired to commit a misdemeanor, namely: loitering and disorderly conduct. They were also allegedly found at the gate of Peter Gomez’s yard, behaving in a manner likely to disrupt the peace. They were charged with obstructing or harassing the public.
When the indictment was read out in court, they all pleaded not guilty.
In his ruling, Magistrate Touré told the court that the prosecution had failed to charge the defendants under the correct provisions of the Criminal Code. He therefore acquitted the defendants and released them.
However, he warned the defendants not to stay at the gate of the plaintiff’s yard again, otherwise they would be punished by law. Finally, he released them from the dock.
