Mbabane – “The money that brought us together is gone now and there is nothing I can do to change that.”

This and other submissions were made by jailed former Hosea MP Mduduzi Bacede Mabuza. He was responding to documents filed by his wife Hloniphile Mabuza, who is taking him to court over child support. Hloniphile wants the former MP to pay €50,000 a month in child support. Barsade argued that it was obvious that his wife did not care about what he was going through and all she wanted from him was money, no more, no less. He stressed that he had money before but no more now. “I have been in detention for almost three years but that has never stopped me from doing the best I can to provide for my family with my very limited income, to be exact, the monthly pension I receive as a former MP is about €12,000,” Mabuza said.

He told the court that he did not wish the suffering of prison on his worst enemy. The former MP said he hoped Hloniphile, as his legal wife, would stand with him “in the rain even if she could choose not to”. “The fact is, I have a large family and the pension I receive is not enough to support them all. In this regard, I would be remiss if I did not express my sincerest gratitude to my extended family, especially my brothers and sisters, for their continuous support to the needs of my immediate family. Thank you very much, boMshengu, and may the Almighty God continue to bless you,” Bacede said. “As the saying goes, history has no blank pages, the applicant (Hloniphile) should say, I once owned several successful businesses. Sadly, these have disappeared and now exist only in history books,” the former councillor said in his affidavit.

Hloniphile also wants the court to compel her husband to pay school fees totalling €19,302 for their three children. She also pleads for the court to order her husband to pay and/or assist in paying the €18,000 car instalment owed by Standard Bank in May 2024. “It really pains me that just because I have no money, the applicant (wife) can treat me badly the way she has and take advantage of our innocent children in the process,” Barsade argued in his reply.

He told the court that he had known the applicant (Hloniphile) for nearly a decade and he thought he knew her but it was only now that he realised through her behaviour that he was wrong. “The applicant’s behaviour showed that she is a callous, sinister and deceitful person who is not afraid to sacrifice our children,” the former legislator said. He claimed that when his wife left in November 2023, she showed unparalleled cruelty by abandoning his three children, as well as another child who she had lived with him since he was nine months old and raised as her own.

According to Barsade, only the helpers who were also left behind saved the situation. The former councillor said in his 22-page affidavit that like other couples, his marriage to Hloniphile was not immune to challenges. But he insisted that they should not use their children for revenge at any time. “Since the applicant has slandered me without reason and treated me with such contempt, I now confirm the adage, ‘You only see the true face of a person when you are no longer useful to others’.” The accused (Bassede) told the court that he did not know where his wife lived and therefore could neither admit nor deny. He noted that he had three children with his second legal wife, Hloniphile. The former MP narrated that he was arrested in July 2021 and subsequently detained at the Matsapha Correctional Facility and is currently awaiting sentencing by Justice Mumcy Dlamini on terrorism-related charges and murder.

He stressed that he was not in a position to manage anything, let alone a trust, as alleged, considering the very troubling and frightening living conditions he was living in the Matsafa Correctional Facility. “To avoid any doubt and at the risk of repeating myself, I was truly detained and I dare say that my life stopped from the moment I was detained,” he argued. Barsade claimed that his wife had until now disclosed the schools their children attended, their respective grades and years of study, without his knowledge.

He claimed that he had always known that the children were attending school near Manzini and not in Mbabane, as his wife had stated in the document. He claimed he had not consented and that he was not consulted when Hloniphile decided to send the children to a school near Mbabane. “The applicant’s actions can only lead to one conclusion, that she is now using the children to extract money from me, and unfortunately, I no longer have money. If apologising to her that I no longer have money will make her feel better and stop harassing me, then I am sorry,” the former MP said.

Meanwhile, in her application filed under a writ of urgency, Hloniphile argued that her husband’s obligations as a father are not diminished by his incarceration. She said that even though they may have differences, it should not affect their children. She claimed that she told her husband that the needs of the children should be prioritized but he turned a deaf ear to her. “He also told me that even if I approach the respectable court for help, I will not get it because he is currently in detention, he cannot be responsible for my upbringing and that of the children and no court will hear my request,” Hloniphile said.

The wife also told the court that she was sinking into debt and that she was in debt because her husband would pay it back monthly. Hloniphile stressed that Bacede would usually pay for her allowance, living expenses and school fees and/or related expenses through the Ekhabeni Family Trust Fund or his personal account. “I would like to add that every time there was a misunderstanding between me and the accused, he would cut off our financial resources without considering the children, who are innocent,” Hloniphile alleged. Yesterday, Justice Bongani Dlamini adjourned the case to July 5, 2024. Hloniphile’s lawyer is Nosisa Hlophe and her husband’s lawyer is Gcina Mhlanga.
