Now, lawyers for Samoan poet Sia Figiel have applied to the Samoan Supreme Court to pay a sum of money to have her released from prison pending sentencing.
Figill is accused of killing Samoan professor Carolyn Sinawaana Gabbard and has announced plans to plead guilty to the murder charge.
Figier reiterated his wish during an appearance in Samoa’s High Court earlier this week, referring to his lawyer, Unasa Iuni Sapolu.
The prosecutor, Mr. Maiavathele Timothy Fesili, disclosed in court that after considering the case, they will proceed to trial all charges, including murder.
But the defence responded that the accused still stood by his answer, saying he had not broken any laws, and offered to organise a payment to have him released pending trial.
The Honorable Judge Fepuleai Ameperosa Roma has scheduled a hearing on Figiel’s request on September 9 before Senior Judge Vui Clarence Nelson.
Figill has been incarcerated since the May accident that killed Gabbard.
Two weeks ago, Figuel’s lawyer expressed the defendant’s view that he would withdraw his request to pay part of the costs for his release and wanted him to change his answers to the charges.
The Samoa Observer also reported that the accused wanted to reach an agreement with the government to drop the murder charge but reach an agreement on a review of the manslaughter charge.
But for now, the government has scheduled the review to take place in March next year.
It’s unclear what happened to the psychological evaluation Figuier requested.
