Today, President Bashar al-Assad promulgated Law No. (24) of 2024, which imposes penalties and fines on anyone who violates power and communication network systems and components, up to a temporary imprisonment of at least ten years and a fine equal to five times the value of the stolen materials, in addition to other penalties, including all those involved in the transfer, concealment, possession, sale, purchase of stolen materials or in any way changing the form or nature of stolen materials in order to conceal their origin and facilitate their disposal.
The law aims to impose deterrent penalties on criminals who hack into these two networks, in proportion to the combined degree of danger posed by their actions, as these criminal acts cause serious damage, create chaos in the State’s economic facilities, hinder its operation, and disrupt the provision of basic services to citizens.
Here is the text of the law:
Law No. (24)
President of the Republic
According to the provisions of the Constitution.
It is based on what was approved by the People’s Majlis meeting held on 25 November 1445 AH (equivalent to 2 June 2024 AD).
Now issued as follows:
Article 1-
In applying this Regulation, the following terms shall have the meanings indicated next to them:
– Electricity network: the public electricity network, including all equipment, tools, tools, cables, accessories, towers, cables, transformers, generators and the connections necessary to carry the electric current from the generating station to the meter of the electricity user or beneficiary, in addition to all types of energy systems connected thereto (generators – solar – wind) and all their complements or any components related to their action.
– Telecommunications networks: all types of public telecommunications networks, as well as supplies and material resources owned, held or provided by telecommunications operators or telecommunications service providers, such as equipment, stations, antennas and their accessories, such as cables, tools, tools, cabs or any components related to their operation, as well as all types of energy systems connected to them (generators – solar – wind) and all their accessories or any components related to their work.
Article 2 –
Anyone who steals electricity or communications networks or any of their components will be sentenced to at least ten years in prison and a fine equal to five times the value of the stolen material. This penalty applies to all persons involved.
Article 3 –
Except as provided for in Article 218(e) of the Criminal Code, any person who knowingly transfers, conceals, possesses, sells or purchases stolen materials shall be sentenced to fixed-term imprisonment of not less than six years and to a fine of not more than five times the value of the stolen materials, or in any way changes the form or nature of the stolen materials in order to conceal their origin and facilitate their disposal.
Article 4 –
All tools, machines and devices used in the commission of the crime, including means of transport, shall be confiscated if their owners have knowledge of the same.
Article 5 –
In any of the following circumstances, the penalty prescribed in Article 2 of this Law shall be increased by one third:
1- If the act is committed at night.
2- If the act is committed by two or more persons.
3- If the act was committed by an employee or contractor of the entity that suffered the theft, or by a person who holds a job position that facilitates the commission of the act.
4- If the thief is carrying a visible or concealed weapon.
5- Preparation or facilitation of the crime, ensuring the offender’s escape or seizure of the stolen goods, if the theft was accompanied by violence against another person.
6- If the action results in fire or personal injury.
B – If the theft occurs in any of the four cases specified in the preceding paragraph, or results in the death of a person, the penalty shall be life imprisonment.
Article 6 –
A – Any person who has knowledge of one of the offences provided for in this Act and does not report it to the public authorities, does not testify or conceals information or evidence relating thereto shall be sentenced to imprisonment for a term of not less than 1 year but not more than six months.
B- If he misleads an ongoing investigation concerning him, the penalty shall not be less than one year’s imprisonment.
Article 7 –
If an accomplice returns the stolen property before it is destroyed or indicates where it is hidden, which leads to its actual hiding place, the penalty prescribed in Articles 2 to 3 of this Law shall be reduced by one third. This reduction does not apply to other participants in the crime.
Article 8 –
Anyone who commits one of the crimes provided for in this Law, if he is a State employee or employee, shall be referred to the competent court. After the final decision, the Public Prosecution Service shall transfer the case file to the competent disciplinary body or court.
Article 9 –
The law will be published in the official newspaper.
