On June 14, a man called the Tafuna Police Station (TPS) because Mr. Tavita Tuisalo’o threatened them with other men they were working with in a garbage bin in Futiga.
The caller to TPS said Tuisaluo tried to stab them and when the police arrived, the accused also attacked the police with the tip of the spear and four of them ended up in a chase with the police and some people who were present at the time.
According to government records, the callers to the TPS explained that the defendant used a long stick like a harpoon to threaten them and another man who was working with them. They ordered the defendant to leave the garbage dump in Futiga to prevent others from getting hurt.
When police arrived, they were speaking with a man who had called from TPS, who explained that at 7:35 a.m. that morning, a white car had parked outside the garbage fence and the man they were traveling with had walked toward it (Witness #2).
Witness #2 instructed the person in the white car to weigh the trash before throwing it away. However, according to Witness #2, the person who called the police said that the instructions seemed unclear or the person in the car did not understand. The defendant then jumped out of the car with a sharp blade and began to curse loudly, saying that he would stab him if he did not leave with the trash.
Witness No. 2 explained that he was very worried that the accused would stab him with the spear, so he hurried back to the office and when he went to the office, he heard the sound of the accused’s tractor and the sound of the stove.
There was another witness who saw the accused being beaten, someone who worked with them.
The caller to TPS pointed out the police station where Tuisaluo was located and because the police saw the defendant smash the front window of his car, the police tried to slowly approach him.
But when the police tried to talk to Tusaruo, the man turned and tried to hit the police with a metal pipe held in his right hand and threw rocks in his right hand.
Police tried to resolve the situation but Tusaruo walked towards them, swearing and ordering them to leave.
The officer then returned to the car and asked other officers for help. As the officers waited for help to arrive, Tusaruo walked back, continued to curse loudly, and threw his pipe at the police car. But when he missed, he immediately ran towards the police car.
According to government records, the police retreated because they hoped more officers would arrive to help.
As the police car retreated, many other vehicles were preparing to dump their garbage and the police stopped them and ordered them to go to a safer place.
But this time, Tuisaluo ran towards a pickup truck parked on an embankment and tried to beat the driver, who was holding five rocks. But when the police tried to attract him, Tuisaluo turned around and chased the other three people, throwing rocks at them.
When Tusaruo did not find the man he was chasing, he turned to the ASPA bar where some of his workers were and started throwing rocks and sticks at them, which happened to be in his hand. But this time the police were approaching and trying to arrest the man. But Tusaruo saw the police car coming, he ran towards it and continued throwing rocks.
The police tried to use the police car as a barrier between Tuisaluo and the people who were there that morning. But the situation turned into Tuisaluo being hit by the car and falling, and the police arrested him with the help of ASPA staff.
Government records also state that police and ASPA workers had difficulty restraining Tusaruo, but eventually locked him up and removed him and rushed him to TPS, where his injuries were treated by an EMS team.
Tuisaluo requested to be taken to hospital, where he was taken and detained at 9:16 a.m. that day. But at 5:10 p.m., a doctor examined him and confirmed that he had some cuts and bruises on his body.
The doctor also informed the police and confirmed that the man was involved in a drug trafficking gang.
Tuisaluo was taken to TPS by the police for further investigation. Tuisaluo said that he lost consciousness that morning due to some problems with his family.
Tuisaluo was charged with two offences, including:
Count 1: Causing a disturbance in a public place – a class ‘B’ misdemeanor, punishable by up to 6 months in prison or a $500 fine; or both.
Count 2: Assault in the Third Degree – a Class “A” Misdemeanor, punishable by up to one (1) year in prison or a $1,000 fine; or both.
The defendant will be held on $2,000 bail pending trial.
