A 19-year-old man has been charged with assaulting and battery on his father
On June 28, 2024, a man contacted the Tafuna Police Department to report that his son was causing trouble among Falenyiu’s family.
According to government records, 19-year-old AJ Mailani was drunk that night and making noise among his family.
When the police arrived at the scene of the accident, they interviewed two witnesses. The first witness was the defendant’s “aunt”. He described that at 3:10 pm that day, when he was inside the house, he heard a noise outside the house.
When he went outside, he witnessed his “nephew” (the accused) swearing at his father. He also mentioned that the accused was yelling and swearing at his daughter and he tried to stop the accused but the accused continued to yell.
The “Aunt” also stated that the defendant grabbed the window and hit his head, causing swelling of his left eye and bruising of his forehead, as stated in government records.
The “auntie” tried to pull the window away from the defendant, but this caused the auntie to fall and hit the stone. She fell down with the defendant.
Witness #1 also stated that this was the first time the defendant was raped, which was confirmed by the defendant’s ancestors.
The accused’s father explained how he tried to get rid of his son while swearing at his family and his wife’s brother, however, his neck suddenly popped and he challenged him to a fight.
The defendant’s father also said he tried to stop his son, but the defendant reached out of the window and hit himself on the head.
That same day, police locked up the defendant and took him to Tafuna’s office and notified emergency personnel to treat the defendant and his aunt’s injuries.
The 19-year-old man was charged with:
Count 1: Causing a disturbance in a public place – a class ‘B’ misdemeanor, punishable by up to 6 months in prison or a $500 fine; or both.
Count 2: Possession of Alcohol Under Legal Age – a Class “B” misdemeanor punishable by up to 6 months in jail, or a $500 fine, or both.
Man detained for violating law and order
On June 25, 2024, a mother went to the Tafuna Police Station to file a complaint that her husband had violated the Civil Protection Order (CPO) by going to their home in Maralemi through his wife.
(Samoa News is not publishing the names of those involved in the case for the sake of protecting minors.)
According to government records, the mother brought a copy of the CPO and a written statement regarding her husband’s violation of the provisions of the CPO. He also brought some photos taken by his daughter near the Malalemi home, in which the accused can be seen.
The mother explained that according to the Chief Public Prosecutor, her husband or the accused were not allowed near the house, nor were she and her two young children.
But that day, her daughter posted photos of her husband standing next to her house, and her daughter also took photos of her husband’s parking lot, which was on the other side of their house, about 100 feet away.
Additionally, the mother described the defendant’s attempts to talk to her children, which is prohibited under the Criminal Procedure Code.
The police separated the accused from his family in Nuuli and informed him that he had violated the provisions of the Criminal Procedure Code.
He is now charged with one count of violation of the Criminal Procedure Code, a Class “A” misdemeanor punishable by up to one year in prison(1) or a $1,000 fine; or both.
There is a $3,000 bond to allow him to return to await trial.
