The Fight Back Act would allow victims of unethical deepfakes to sue those who created or manipulated the images.
Under the bill, victims found in such deep fake incidents could receive up to $150,000 in damages. If the incident was related to “defamation or attempted defamation, stalking, or harassment” or the “direct and proximate cause” of those injuries, up to $250,000 could be awarded. The bill now must pass the House of Representatives before it can be sent to the president for his signature.
Many people first became familiar with unethical, non-consensual deepfakes when an AI-generated image of singer Taylor Swift went viral on social media earlier this year.
Such images have also become a problem in schools across the US, with female students finding AI-generated images of themselves shared by classmates.
Unethical deepfakes are “not a fringe problem that happens to a few people, but a pervasive problem,” Senate Majority Leader Chuck Schumer said in a speech on the Senate floor. “These damaging and destructive images destroy lives.”
Schwimmer said the FIGHT Act is just one example of “the barriers to AI that I talk about all the time.” “AI is an amazing technology that can create incredible innovation, but we need to cross barriers to prevent the abuses associated with it.” Earlier this year, he laid out a roadmap for how a Senate committee could approach AI legislation.
