The High Court has ruled that the Malawi Congress Party (MCP) National Executive Committee (NEC) has no power to impose new eligibility criteria on candidates vying for top office.
The National Executive Committee of the Malayan Communist Party passed a resolution prohibiting those who have not held any position in the party for two years from running for the National Executive Committee position.
“The NEC has no power to adopt eligibility criteria, contrary to the provisions of its constitution,” Justice Howard Pemba said while reading the judgment.
MCP member Eddie Banda applied to the court to quash the NEC’s resolution.
