Bannon, who was found in contempt of court for refusing to appear before a congressional committee and turn over requested documents, is due to surrender to prison authorities on July 1.
The congressional committee’s investigation focuses on Trump’s attempts to overturn the results of the 2020 presidential election.
Bannon was sentenced to four months in prison but appealed the verdict.
A three-judge appeals court in Washington, D.C., upheld the lower court’s ruling, and last month Trump-appointed Judge Carl Nichols upheld prosecutors’ request to order Bannon to begin serving his prison sentence.
Bannon appealed Nichols’ decision to the Court of Appeals, seeking to keep his head free as the case moves through the court system and potentially all the way to the Supreme Court.
However, the appeals court concluded that there was no reason in Bannon’s case to grant him immunity.
Notably, the court was split: Two of the justices, one appointed by Joe Biden and the other by Barack Obama, wanted to send Bannon to prison, but the third, a Trump appointee, said he should walk free pending a final decision in the case.
