New legal track for OUS dispute

In March 2023, Redd Ullevål Hospital filed a lawsuit against the state government at the Ministry of Local Government and Regional Affairs to declare the state government’s zoning plans for Aker and Gaustad invalid. One of the reasons for this is that these plans conflict with the EU planning directives, which Norway has committed to comply with through the EEA agreement.

The state government dismissed the lawsuit for various formal reasons and won in both the district court and the appellate court. The Supreme Court has now reviewed these courts and decided that the lawsuit must be heard in court. At this point, the dispute surrounding the new OUS has officially entered the legal track.

The Supreme Court’s decision received almost no comment from the media. That should have been the task of Aftenposten and Slatterholme.
