On the morning of June 1, 2024, Mr. Pele Finau called the Tafuna Police Station to seek help regarding the theft of his electric washing machine. Pele’s 23-year-old brother, Tevita Finau, came under suspicion.
According to government records, when police arrived at Bailey’s home, they saw three men and a woman in front of the house. During the conversation between police and Bailey, he explained how his father took him to work and when his sister called, her brother, Tevita, raided their house.
This happened because he was returning home with his father. When they arrived, they saw that the door of their house was broken, as if someone had kicked it and it could not be closed.
Bailey also explained that he knew it was his brother who did it because every time he came to their house, he would steal the family’s property and sell it to other people.
Bailey also said one of their neighbors told him he saw Tevita break down the door to the house and take out a “power washer.”
Police also interviewed the witness, who said he saw the defendant walking in his father’s house while he was standing in front of his house. He also heard noises coming from the defendant’s ancestor’s house, and when the witness went to see what was going on, he saw the door was open but the defendant was pushing out a “power washer.”
Witnesses also saw the accused put the “power washer” into a wheelbarrow and then dragged it towards the road and put it into a car suspected to be owned by Mr. Sulu Development.
The police then went to look for Mr Tevita and when they approached the P&F store, they saw the man walking towards the market on the other side of the road. The police locked him up there.
When the police questioned the suspect, he explained that his brother asked him to buy a “power washer” in order to raise money for his birthday. When the defendant found out that his brother and father had left home, he immediately went to get the “power washer”.
The accused also explained that he took the “power washer” and sold it to Development for $25. The police then went to Atina’e’s home to look for him, but his “auntie” told him that the man had gone to pick up his workers in the morning and had not returned home. The police also questioned Atina’e’s female friend, but she also mentioned that Atina’e had left to pick up her employees and had not returned. The “auntie” and the female friend were instructed to advise Atina’e to contact the police station when he returned home.
That morning, Adina called the Tafuna police station and asked why they were looking for him. The police advised him to go to their office to give a statement.
Atina’e said that when he arrived at the police station, he went to Pavaia’i to pick up his employees and visit some of his family members. But when the defendant was standing on the roadside on his bicycle, he found a “power washing machine”.
Atina’e asked the defendant what he was doing, but Mr. Tevita replied that he wanted Atina’e to buy his “power washing machine.” Atinee said he only had $25 in his money, so the exchange was made.
Government records also state that defendant’s brother and his father testified that they did not instruct defendant to purchase a power washing machine.
Mr Tevita was charged with three offences:
Count 1: Robbery in the Second Degree – a Class “C” felony punishable by imprisonment for not more than seven (7) years or a fine not more than $5,000; or both.
Count 2: Theft – a Class “C” Felony punishable by not more than seven (7) years in prison, or a $5,000 fine; or both.
Count 3: Damage to Property in Count 3 – a Class “B” Misdemeanor punishable by up to six (6) years in prison or a $500 fine.
The defendant will be released on $2,000 bail pending trial.
