A Florida judge on Monday threw out a criminal indictment against former President Donald Trump over his handling of secret government documents, citing doubts about the appointment of special prosecutor Jack Smith, who brought the case to court.
A request by the former president’s lawyers to dismiss the case was granted by Judge Aileen Cannon, who was appointed by Trump in 2020. The decision was a major victory for the Republican former president as he seeks to return to the White House.
Trump’s lawyers have argued that special counsel Smith’s appointment was illegal. Smith’s team disputed those arguments before Cannon last month. He has not yet commented on the decision.
