It is noteworthy that in 88% (30) of the cases examined, the courts ruled in favor of the plaintiffs and cancelled the TCC fines.

Since the introduction of the new rules for military registration violations, Ukrainian courts have heard at least 34 cases asking Ukrainians to appeal TCC fines.

In 30 cases, the courts ruled in favor of the plaintiffs and cancelled the fines, and in 4 cases, the courts rejected the citizens’ requests and upheld the fines. In addition, the register contains an appeal against the fine by a woman who is a medical professional.

Opendatabot noted that more cancellations involved violations that occurred before the legal change came into effect. The court took into account that the law is not retroactive and, therefore, the new rules do not allow for the punishment of long-standing violations.

In particular, the case arose in a case where a woman, a doctor by profession, challenged the TCC’s fine. When the plaintiff was undergoing medical education, there was no obligation to register – the court overturned the fine.

In 20% of cases, fines were appealed due to violations of prosecution procedures or lack of evidence of a crime.

For example, OpenDatabot cited an appeal by a man who was fined for not registering at the Selective Service Center, even though two weeks earlier the man had been issued a temporary military registration certificate.

Otherwise, a man who went to the TCC to clarify the data went to court, but received a fine. In the resolution, the representatives of the TCC did not prove the crime and missed the deadline by which they could be punished for it – the court cancelled the fine.
