The Dubai Civil Court has ordered an Arab national to pay his ex-wife Dh1.849 million, which he borrowed from her during their marriage, to repay a debt. He divorced her and the divorce became final without paying the amount he owed her.
The case details stated that an Arab woman filed a lawsuit, claiming that she was the defendant’s wife, and that the defendant divorced her in early 2021 and did not return her to his wife, and that he was facing financial difficulties during the marriage and owed the bank Dh1,584,500. It was bank financing, and they agreed to obtain a loan to repay the debt owed by the defendant, so they applied to another bank to obtain a real estate loan in the amount of Dh3,096,038 in exchange for the mortgage of one of the villas located in the fourth Al Warqa area owned by the wife, for the benefit of the bank.
The lawsuit also states that the couple agreed with the bank that the monthly loan instalments would be deducted from the account belonging to the wife, they obtained the required financing and used Dh1,578,500 of it to repay the defendant’s debt. She also transferred Dh595 from her account to her husband as a debt because her husband was unemployed, on the condition that he would pay her after he found a job. The plaintiff deserved a total of Dh1,992,391 in compensation from the defendant, but the defendant made several friendly requests and never took the initiative to pay.
The plaintiff’s legal representative, Dr. Alaa Nasr, said she was forced to approach the court to commission an accounting expert to settle the feud between them in order to get justice. The expert submitted his report. , stating that the plaintiff deserved AED1,849,822 (one million eight hundred and forty-nine thousand twenty-eight dirhams), so she filed a civil lawsuit.
He added that the court was satisfied with the expert’s report and concluded from it that the above amount was the net amount owed to the woman by her ex-husband, especially because, despite the defendant’s notice, he did not pay the legal fees or defense. Therefore, the court, in the presence of the defendant, ruled to pay the plaintiff the amount plus statutory interest from the date of the claim until the date of payment, and he was obliged to pay costs and attorney’s fees of one thousand dirhams.
