On Monday, July 8, 2024, the Investigation Control Room overturned the order of the Military Court, which ordered the provisional detention of Me Guy Hervé Kam for procedural purposes. On Tuesday, July 9, 2024, his lawyers gathered inside the Military Court and stood motionless for two hours, waiting for the prosecutor to determine the practical conditions for his release. After a closed-door meeting of legal professionals, Me Kam has not yet been released.

“We have been informed that the practical conditions for his release have not yet been met.” These are the exact words of Me Ambroise Farama when asked why their client is still in detention. At the same time, when asked what he meant, Me Farama clarified: “I cannot give you more details because only they know what they are preparing in practical terms.”

“Me Kam’s detention is arbitrary and unlawful”

According to his lawyer, Me Kam is still being detained at the Armed Jail and Correctional Facility despite the decision of the Investigation Control Room to release him, a decision of the prosecutors they said they did not understand because after this decision he should normally be able to walk freely the next second.

“When such a decision is made, the detainee is released and for us, Mr Kam should have been released since yesterday for a simple reason: we are dealing with a deprivation of liberty, which no citizen can be. If someone is detained solely on the basis of a judicial decision, they are deprived of their liberty. In this case, an order had been made, but it was overturned yesterday. Therefore, once the order was overturned, Mr Kam was no longer in MACA. This means that he was held in this prison without any court decision, which deprived him of his liberty. “This is an arbitrary and unlawful detention”, concluded Me Ambroise Farama.

“We are concerned that after such a decision, Mr. Gan will still be detained for about 48 hours without any legal basis.”

“Me Kam has a combative mentality.”

Me Kam’s last arrest dates back to May 29, 2024. According to his lawyers, they have been in contact with him until now. “We can meet him at any time and communicate with him without difficulty; he is convinced of his innocence and is ready to answer before the justice of his country,” assured me Ambroise Farama.

When asked if they were targeting their colleagues, speakers would respond: “For us, the ruthlessness is obvious.”

“We believe nothing can prevent his release and it is time for him to be released.”

“They gave us another appointment for tomorrow morning at 9am.”

Regarding the practical conditions for the release of detainee Me Kam, the Military Court has scheduled a meeting with his lawyer on Wednesday, July 10, 2024 at 9 a.m.

This time, they expressed the hope that the decision will be implemented. “This is the third court decision that has been made ordering the release of Me Kam. The first was a decision by the Administrative Court, which ordered his immediate release. The second decision was made by the Administrative Court. The Administrative Court of Appeal did not comply, and since yesterday a third decision has been made ordering his release, until then we are waiting for the implementation of that decision, which in any case we hope will be implemented by tomorrow at the latest. , this decision will be implemented,” concluded Mr. Ambroise Farama.
