The Director of Criminal Prosecutions at the Directorate of Public Prosecutions, Dzikondianthu Malunda, said the state had decided to appeal to the Supreme Court to protest against the High Court’s judgment in Mzuzu which acquitted four suspects except Tadikira Mafubza, stepson of former President Peter Mutharika, and three others.

Marunda said the government was not happy with the decision of High Court Judge Gladys Gondwe acquitting the four persons and had decided to appeal the decision after consultation.

As the prosecution failed to provide sufficient evidence, Judge Gondwe found the eight not guilty as she believed they did not need to plead.

Meanwhile, the Public Relations Officer of the Legal Aid Bureau, John Namalenga Junior, said the Bureau represented the six suspects and they would continue to represent their clients in the Supreme Court.

The suspects have been charged with manslaughter and aggravated trafficking in persons, with 30 Ethiopian citizens found buried in a mass grave in October 2022 in the Mtangatanga forest in the Mzimba district.
