The President of the Constitutional Court, Holta Zaçaj, confessed in a communication to the media regarding the decision on the term of office of Olta Xhaçka.

Zakai said parliament questioned the court’s binding force and demanded the immediate implementation of the decision.
She added that parliament must vote based on the Constitutional Court’s decision.

Today, the Court concluded that the Parliament had not implemented its Decision No. 1. The Court held that the Albanian Parliament had challenged its binding force through its ruling of April 11, 2024.
The court stressed that its decision had legal force and effect and no one was allowed to discuss it, let alone enforce it.
The decision is binding both in terms of the order and the reasoning. The Court stressed that the decision has enforceable effect. This means that Parliament and its representatives must vote in accordance with the Court’s ruling.
The court decided to partially accept the request to resolve the conflict between the parties.
The General Assembly is obliged to implement this decision immediately.
The President of the Constitutional Court stressed that Parliament should take immediate action, adding “In both cases, the motions for rehearing and even the motions for amicus briefs were denied by the court.”
Zachaji: When you say it is urgent, Parliament has to act. We are taking a second decision on the same issue and it is still up to the political authorities to decide whether to implement what we decided in the most recent decision, whether to make this issue a priority because we have given it priority to review, but we have not set a deadline.
In both cases, motions for new trials and even motions for amicus briefs were denied by the court.
