The Eldoret High Court has ordered the arrest of DCI Cyber Crime Officer Daniel Kieni for allegedly concealing key evidence in the murder case of lawyer Abel Mogaka.
The court had expected Keeney to produce CCTV footage as key evidence, but he failed to appear despite repeated summons.
Lawyer Abel Mogaka is facing charges for the murder of his colleague Calvin Nguela during a three-day house party in Eldoret town. A disturbance reportedly broke out at the party and Mogaka allegedly stabbed Nguela with a broken beer bottle. The incident took place on May 18, 2019, at a house in the Annex area along the Eldoret-Nakuru highway in Wasingishue County.
The accused denied the charges and was released on bail of Ksh1 million and a corresponding surety.
The judge in charge of the case, Robert Wananda, criticized Gini’s behavior as abnormal and detrimental to the progress of the case.
“Despite multiple summonses and assurances of appearance, the officer neither appeared in person nor provided an adequate explanation.” ” said Judge Vananda.
Justice Wananda, disturbed by the officer’s actions, issued an arrest warrant for Keeney and directed the head of the Cyber Crime Unit at the DCI headquarters in Nairobi to carry out the arrest.
The judge expressed regret that the actions of such police officers had led to delays in many court cases.
“An arrest warrant has been issued for Inspector Daniel Kieni of the Cyber Crime Unit of DCI Nairobi. The arrest will be carried out by the Head of the Cyber Crime Unit of DCI Nairobi,” Justice Vananda ordered.
The court will re-examine the murder case on October 18, 2024.
