Court: Guidelines for public bidding cases formulated during the COVID-19 pandemic remain valid

At the height of the COVID-19 pandemic, Chief Justice Terrence Rannowane issued a practice direction on public tender cases. The direction, issued under the High Court Rules, begins by explaining that public tender cases were “taking excessively long to resolve”, a situation that has led to “delays in project implementation and infrastructure development, cost overruns and
difficulties associated with it. ” Based on the latter, Rannowane instructed that cases related to public tenders “must be treated as urgent applications and must be managed, set aside and disposed of quickly and should be given priority and removed from the normal track of other cases.” The directive came into effect on February 8, 2021.

While the directive was never rescinded, the state believed otherwise and made that argument before Justice Boipuso Makhwe in an emergency application case in which it was a party.
