In a statement dated August 1, 2024, received by Lefaso.net, the SENS movement condemned the brutality of the political judiciary. The movement said it was consulting the national and international public on everything that might happen to its national coordinator, Me Guy Hervé Kam. The full statement is below.
Declaration of the SENS movement on the political and judicial brutality of Maître Guy Hervé KAM.
Maître Guy Hervé Kam, the national coordinator of the SENS movement, has been held captive for more than four months since he was abducted on 24 January 2024 by agents claiming to be State security agents. On 29 May 2024, he was transferred to the Research Section of the Gendarmerie in Ouagadougou in an indecent mock release.
The next day, 30 May 2024, he was brought before the Second Cabinet Investigating Judge of the Ouagadougou Military Court, who indicted him for conspiracy and criminal association. A provisional detention order was subsequently issued against him and a warrant of detention was issued against him, placing him in the Armed Prison and Correctional Institution (MACA).
Maître Guy Hervé KAM appealed against the decision to detain him. On 8 July 2024, the Military Court Control Chamber ruled on this appeal, overturning the detention order and ordering his immediate release. The court ordered that he be placed under judicial supervision, the terms of which should be determined by the examining magistrate.
Despite the terms of this decision, Maître Guy Hervé KAM will continue to stay in MACA against all odds, which is completely illegal. Until July 10, 2024, he will finally be able to return home and will be obliged to undergo a rigorous judicial review, never seen before in our legal history. But as a good citizen, Maître Guy Hervé KAM complies with his conditions, even if he appeals against the above measures.
But this release did not suit the taste of the princes of the time, who quickly attached “new conspiracy facts” to him. As if to confirm these rumors, the daily newspaper “Observer Parga” in the section “A Letter to Laye” on July 26, 2024 revealed the ongoing conspiracy aimed at plunging him into darkness again. Conspiracy events based on the statements of “a person who has been still for a long time”.
Therefore, today, August 1, 2024, Me Guy Hervé KAM was summoned by the Military Prosecutor’s Office, questioned, detained by the police and imprisoned again in MACA.
The new “season” of this political-judicial soap opera clearly shows the MPSR 2 powers’ stubbornness in circumventing the Inspectorate’s decision on his release and the directives that ordered his release. This “new dossier”, which contains no new facts, is nothing more than a political conspiracy, a ruthless act aimed at putting him in a dungeon. Me Guy Hervé KAM is therefore a disturbing political opponent who must be silenced in order to disqualify him and his movement from the political arena.
This ruthlessness and persecution of Maître Guy Hervé KAM and all those who take a position that opposes the monolithic ideology that we seek to impose by all means is unacceptable and reprehensible. It should be remembered that justice, even military justice, is done in the name of the Burkina Faso people. It can never become a tool to silence political opponents or settle political grievances.
For almost a decade, our people have suffered the horrors of terrorism. The State, whose primary duty is to provide security for all its citizens and all the population living in Burkina Faso, must cease to be a source of insecurity. Captain Ibrahim Traoré must not forget the meaning and scope of the oath he freely took before the Constitutional Council on October 21, 2022, to “respect, implement and defend the Constitution, the Transition Charter and the laws, doing everything possible to guarantee justice to all the inhabitants of Burkina Faso.”
The SENS movement therefore calls on the authorities to stop the harassment and ruthlessness towards our National Coordinator. He calls on national and international public opinion to bear witness to what may have happened to Me Guy Hervé KAM.
