According to government records, on the evening of July 6, 2024, a store owner called the Fagatogo Police Department regarding a man causing a disturbance in his store.
When police arrived at the store of a troubled shop owner, they saw a man wearing a black short-sleeved shirt and black trousers walking out of the store carrying a bag.
The store owner informed police that the man was causing trouble in the store and showed police a video recording of the defendant’s behavior in the store.
The police noted that the man accused by the seller, Mr. Sefo Lemalu, is a person who is frequently prosecuted under the law for the same crime.
Police tried to look for the suspect near the store in Yutulle but were unable to find him.
But over the next two hours, police again saw a man walking around in front of the Samoan teddy bear and running towards the market.
That same evening, Fagatogo police received another report of a man causing a disturbance in front of Malaloa’s tool store.
When police arrived, they surrounded a man named Lemalu who knew about the incident and was the one who yelled at Teddy.
But when police tried to interview the defendant, he swore at them and tried to assault a man standing nearby who was swearing at him.
Lemalu also lunged at one of the officers but was restrained by other officers, but when the officers tried to lock his hands, Lemalu jumped up, screaming and cursing.
However, the police managed to lock his hands and took him to Fagatogo Police Station.
Lemaru’s behavior continued at the police station, where he even swore at an officer and attempted to stand on the chair he was sitting on and tried to throw the officer by grabbing his seat.
The police then took Lemaru to the prison in Tafuna. The police reportedly struggled with Lemaru to get him into the car and took him to the prison in Tafuna.
The 36-year-old man was charged with:
Count 1: Causing a Disorder in a Public Place – a Class “B” Misdemeanor, punishable by six (6) months imprisonment or a $500 fine; or both.
Count 2: Resisting Arrest – a Class “C” Misdemeanor, punishable by up to one (1) year in prison or a $1,000 fine; or both.
Count 3: Assault in the Third Degree – a Class A misdemeanor punishable by up to one year in prison or a $1,000 fine, or both.
The defendant posted a $5,000 bond, which would have allowed the defendant to be released from jail pending trial.
