Legal scholar Lord Denning QB has said on social media that he is inclined to believe that an investigation is needed into possible abuse of power by the Director of Public Prosecutions (DPP) Masauko Chamkakala.

‘You can’t just come into office and start casually dropping charges,’ Lord Denning wrote on his Facebook page, adding that this also explained why Parliament dismissed a high-profile case he claimed to be dropping.

“I must say he eventually began to become paranoid,” he wrote.

Lord Denning’s decision came less than a day after Chamkakala dropped the cement gate case against two businessmen, Mahmed Shafee Ahmed Chunara and Ahmed Mohammed Chunara.

The duo are among five people accused of abusing former President Peter Mutharika’s presidential privileges to import duty-free goods for personal use.

Chamkakara confirmed the development yesterday, adding that one of the two men will serve as a state witness, although he did not reveal the identity of that person.

“They admitted responsibility for the tax violations and paid taxes and penalties in accordance with the relevant tax laws,” Chamkakala said.

He added that he needed to verify the exact amount that needed to be repaid.

Documents filed in the High Court in 2022 show that between November 2018 and December 2019, Mahmed Shafee Ahmed Chunara allegedly imported 1,250,770 bags of cement duty-free, claiming that they were for Mutharika’s personal use.

The remaining suspects include Mutharika’s former bodyguard Norman Paulosi Chisale, former National Housing Agency director Peter Mukhito and former Malawi Revenue Authority (MRA) deputy director Roza Mbilizi.
