More efficient repatriation of rejected asylum seekers, compliance with European asylum legislation on the responsibilities of the country of entry and stricter border controls are among the highlights of Germany’s policy in response to the Solingen terror attack. The case of the suspects from Syria shows that the EU asylum system is not (anymore) working, and the big question is whether the implementation of the new legislation will change much in practice within two years.
In this specific case, the German authorities failed to return the Syrian to Bulgaria, for which they were responsible. They also did not extend the deadline for his surrender, and he was eventually given protection in Germany. This is certainly not an isolated case. German data shows that in 2022 Bulgaria, as the responsible state, attempted to repatriate 7,732 people. Only 232 operations were successfully completed. At EU level, less than one in ten of the 163,415 transfer requests were executed.
