Ruto and DP Gachagua given deadline to respond to removal petition

President William Ruto and Deputy President Rigathi Gachagua have until August 16 to respond to a petition from activists calling for their removal from office through a referendum.

Justice Bahati Mwamuye has directed that Ruto, Gachagua and other listed defendants be served with applications, petitions and necessary court documents.

The lawsuit targets Ruto, Gachagua and several other political parties, including the Independent Electoral and Boundaries Commission (IEBC), the Attorney General, the Inspector General of Police, the National Assembly, the Senate and the Ministry of National Finance and Economic Planning.

According to the order of Justice Mwamuye, the defendants must file and give their response to the July 23, 2024 application by the close of business on August 16, 2024.

The petitioner must file any answer, if required, by August 23, 2024. The court will issue further orders or directions on September 24, 2024.

The petitioners, Cyprian Nyamwamu, Khelef Khalifa and Professor Fredrick Ogola, sought the removal of Ruto and Gachagua for alleged corruption, unconstitutionality and incompetence.

They asked the High Court to direct the IEBC to hold a referendum to allow Kenyans to decide whether to end Ruto and Gachagua’s terms prematurely.
