Slovakia will introduce new grounds for banning gatherings. The highest constitutional officer will be entitled to a life annuity and real estate rights under established conditions. This was made in accordance with the lex atentat, the law on certain measures to improve the security situation in the Slovak Republic, signed by President Peter Pellegrini on Monday (July 8). The Office of the President of the Slovak Republic informed about this on its website. The law was discussed in the Parliament in a short legislative procedure. The new legislation will come into force from July 15.

Components

Interference with the exercise of the right to peaceful assembly is prohibited. Now, if the assembly is held near the residence of a person whose employment, occupation or function is directly related to the purpose of the assembly, and the convener does not agree to change the location, it will be prohibited to gather in an area mainly used for housing, which is not a square, park, market or other similar place, and which may interfere with the right to privacy or interfere with the peaceful use of a residence by a large number of people.

The ban on assemblies also applies within a 50-meter radius of the seat of the President of the Slovak Republic, the Government of the Slovak Republic or the ordinary courts. Assemblies will be prohibited, during which conflicts with participants of previously announced assemblies are likely to occur, therefore it will not be possible to ensure the orderly and peaceful course of these assemblies, and if there is no agreement between the conveners to adjust the time or place of the assembly, and if it is held in public, it will not be possible to ensure order by any less intrusive measures. The police force is obliged to inform the municipality of the specific reasons for banning the assembly.

Accommodation for the highest constitutional officials

The President of the Slovak Republic, the President of the National Assembly and the Prime Minister will be entitled to own “well-equipped real estate”. The so-called right will be established under the conditions that the life annuity will be linked to the term of office of the President. The Speaker of the Parliament and the Prime Minister will serve twice as long as the President and will be entitled to receive a salary for life.

Accommodation for the three top constitutional officials will be provided by the Ministry of Interior. A list of specific properties suitable for the residence of constitutional officials should be prepared which would be suitable from a security point of view. “If the Ministry of Interior assesses that any of the facilities under consideration are particularly suitable for security requirements, the constitutional officials will be obliged to use such facilities for protection reasons,” the approved material reads.

Lifetime Annuity

The right to a lifetime salary should be enforced, with two exceptions. The first case is when a person begins to perform another constitutional function. In this case, the conflict can be resolved by suspending the payment of a lifetime salary for the duration of the performance. The second case is a conviction for an intentional crime, which, due to the seriousness of the act, means losing the right to a lifetime salary.

Protection will also be granted to the chairpersons of all political parties and movements that won representation in the National Assembly of the Slovak Republic in the last elections, as long as they are members of Parliament and as long as they do not acquire another function of protection of constitutional officers as a result of their performance. The Attorney General of the Slovak Republic and the President of the Constitutional Court will also be protected. The Minister of the Interior must analyse the current procedure for protection of constitutional officers and designated subjects by September 12. It should also make recommendations on measures to improve the quality of the provision of protection.
