The Military Court ordered the release of Me Guy Hervé Kam on Monday, July 8, 2024. This release could come after an appeal filed by his lawyers, asking the investigating judge to overturn the pretrial detention for procedural purposes.
At the end of today’s hearing, the lawyers’ appeal was initially deemed admissible and well-founded. The judge then overturned the lawyer’s interim detention order, ordered his release if he was not detained for any other reason, and sent him back to the investigating judge, who will decide on the terms of the judicial review.
As a reminder, Me Guy Hervé Kam was arrested on Wednesday, May 29, 2024, just after he was released by the Administrative Court of Appeal, which clearly stated in its judgment that it was defending the State of Burkina Faso to proceed under the same laws. Any arrest, detention or any other action that could infringe the fundamental freedom of movement of Mr. KAM Guy Hervé.
Referring to the case of his second arrest at a press conference on Saturday, May 1, 2024, the prosecutor of the military court announced that his arrest followed the procedure initiated before the prosecution of the First High Court of Ouaga; but later, the prosecution of the military court realized the connection between his file and that of another Daher Sami. “It was in this context that Mekam and other civilians were brought to the military court,” he said.
We should also remember that during his detention, trade union organizations, mainly the SENS movement, which he coordinated, issued statements from all over the place demanding his release, thus condemning the merciless attack on his person.
