The High Court will today give its verdict on a petition filed in 2021 challenging the introduction of the competency-based curriculum (CBC), which replaced the 8-4-4 education system.
The three-judge court will rule at noon on a petition filed by attorney Nelson Havi, who is seeking to repeal the new education curriculum, calling it unconstitutional and illegal.
Judges Hedwig Ongundi, Antony Mrima and Antony Ndung’u will hear the case at 10:30am today.
The case was filed in 2021.
The original complainant in the case was Esther Ang’awa, also an advocate at the High Court, but she chose to withdraw from the case, citing government profiling.
Her name was replaced with Havi.
The documents before the court were subsequently amended to indicate that Havi was the applicant.
The competency-based curriculum was rolled out nationwide in January 2019, covering pre-primary grades 1 and 2 and primary grades 1, 2 and 3.
The 2-6-3-3-3 curriculum has been called the ultimate change in education in the country as it attempts to fill the gaps that existed in the 8-4-4 rote learning system.
However, the government was criticized for failing to prove that it initiated and conducted research to inform the national government on the CBC curriculum, among other things.
