CoA rejects Khama’s former assistant’s plea for scarce skills allowance
The Scarce Skills Allowance Policy introduced by former President Ian Khama in 2008 has sparked numerous controversies and lawsuits. Ironically, in a recent Court of Appeal case, a three-judge panel could not agree with Khama’s former senior private secretary Duke Masilo (himself a lawyer) on the legal interpretation of the policy.
The policy was formally promulgated by presidential decree and came into effect on April 1, 2008, the day Khama assumed office as president. Its purpose was to attract and retain a specific group of scarce professionals (including lawyers, judges and other legal professionals) who found the civil service salary unattractive. Over time, the policy was modified to narrow the group of beneficiaries. In May 2010, the Public Service Management Authority (DPSM) issued a directive to abolish the allowance for E2-level paid officials who did not have a technical position. Subsequently, the Permanent Secretary to the President (PSP) issued a directive in April 2011, stipulating that in order to receive this allowance, officials must not only have relevant qualifications but also be in a scarce skilled profession. For legal professionals, one of the recognized qualifications in this category is a bachelor’s degree in law.
