President William Ruto on Thursday launched the process to fill upcoming vacancies in the Constitutional Commission and independent offices.
The terms of office of the Chairpersons and members of four constitutional bodies are coming to an end.
Ruto has convened three selection panels to pick suitable candidates for the Pay Commission, the Administrative Justice Commission, the National Gender and Equality Commission and the Independent Police Oversight Authority.
The composition of selection committees varies because they are guided by the laws that establish the various committees and independent offices.
Appointments to the Commission and the Independent Office take into account the national values referred to in Article 10 and the principle that the composition of the Commission and the Office as a whole should reflect the regional and ethnic diversity of the Kenyan people.
Personnel holding office must possess specific qualifications prescribed by the Constitution or national legislation.
The members of the Committee shall elect a Vice-Chairman from among their own number at the first meeting of the Committee; a Vice-Chairman may also be elected when a vacancy in the Vice-Chairman’s position becomes necessary.
The Chair and Vice-Chair of a Committee may not be of the same gender.
When a vacancy occurs in the Independent Police Oversight Authority, the President will constitute a selection panel consisting of one person each from the Office of the President, the Judicial Service Commission, the Commission on Anti-Corruption, the Kenya National Human Rights Commission and the Commission on Gender.
ICSC then convenes the first meeting of the Selection Panel, from among its members, and provides the Selection Panel with the facilities and other support necessary for the performance of its functions.
The Selection Panel shall, within seven days of its meeting, publish an advertisement in at least two daily newspapers of national circulation inviting applications for the positions of Chairman and Members of the Committee from persons who meet the qualifications for nomination and appointment.
When a vacancy occurs on the National Gender and Equality Commission, the selection panel consists of one person each from the Office of the President, the Ministry responsible for justice, the Ministry responsible for gender and social development, the Public Service Commission, the Association of Professional Associations of East Africa, the Kenya Private Sector Confederation and the National Council for Persons with Disabilities.
The selection committee determines its procedures and the ministry responsible for the public service provides it with the facilities and other support necessary for the performance of its functions.
In filling the positions on the Administrative Judiciary Commission, the President convenes a selection panel consisting of one person each from the Office of the President, the Ministry responsible for judicial affairs, the Public Service Commission, the Association of Professional Associations of East Africa and the National Council for Persons with Disabilities.
The Selection Committee determines the procedures for the performance of its duties.
The members of the Remuneration Committee are nominated by the Joint Forum of Professional Bodies represented by professional associations in East Africa.
The nominating authority will place an advertisement in at least two local daily newspapers of national circulation inviting applications for membership of the Commission from persons who meet the qualifications for nomination under the Constitution and the SRC Act.
The Chairman convenes a selection panel to select a suitable candidate to serve as Chairman.
The panel shall consist of a chairperson and four other members from the executive and professional organizations.
The chairman and members are part-time and serve for a term of six years and are not eligible for re-election.
